LEGAL CHALLENGES IN COMBATING CHILD TRAFFICKING IN MALAYSIA

Malaysia has enacted the Anti-Trafficking in Persons and Anti-Smuggling of Migrants 2007 (ATIPSOM) Act regulating crime human trafficking Malaysia. The to be read together with other relevant legislations, for instance, Child 2001, Immigration 1956/63, Young Person (Employment) 1966 (Amendment) 2019. Additionally, since is a signatory international instrument related trafficking, implementation laws required observe standard. Such as, instruments include Protocol Prevent, Suppress, Punish Trafficking especially Women Children, Convention on Rights Child, Optional Sale Pornography, Prostitution. This paper aims analyse challenges implementing existing combat child Therefore, this study adopted qualitative approach that applies doctrinal non-doctrinal components by utilising library-based resources conducting semi-structured interviews agencies. findings indicate there are loopholes enforcing several domestic comply standards necessitates improvements terms criminalizing cases, demand supply sexual exploitation, adoption process, status refugee children.
